In India, the rise of e-commerce and fintech fintech has led to the emergence of new legal challenges. This paper analyzes the effects of digital transformation on corporate law in India, with a focus on the adaptation of legal frameworks, the role of intellectual property in digital businesses, and the rise of commercial disputes in virtual environments. Additionally, the paper discusses the challenges faced by Indian corporations in navigating the evolving digital landscape and the need for robust regulatory frameworks to protect both businesses and consumers. Through case studies, we explore the effectiveness of current laws and suggest future reforms to address the growing challenges.

The paper also considers the global landscape, comparing India’s legal approach to IP protection with international standards, and offers recommendations for reform. Special attention is given to the enforcement of IP rights, licensing, and the need for AI-specific legislation in India to address unique challenges in the IP domain.

The research examines legal frameworks in India and other countries for resolving cross-border disputes, with emphasis on arbitration, mediation, and court-based approaches. Challenges in enforcement of foreign judgments, jurisdictional issues, and the impact of international trade agreements on dispute resolution are explored. The paper highlights the role of technology in streamlining dispute resolution processes and proposes recommendations to enhance the efficiency of cross-border dispute management in the changing global market.

The pharmaceutical industry in India has long been a hub for innovation and production of generic medicines. However, the protection of intellectual property rights (IPR) in the pharmaceutical pharmaceutical sector has become a contentious issue, particularly concerning patent law reforms. This paper explores the legal challenges surrounding pharmaceutical patents, including the balance between protecting innovation and ensuring access to affordable medicines. By examining India’s patent laws, including the controversial Section 3(d) of the Indian Patents Act, the paper assesses the implications for both domestic pharmaceutical companies and international patent holders. Furthermore, the paper proposes reforms to enhance patent law’s effectiveness while fostering innovation in the Indian pharmaceutical market.

This paper examines the legal hurdles involved in M&A transactions in India, focusing on the Competition Act and its enforcement by the Competition Commission of India. By analyzing case law and regulatory challenges, the paper assesses how India’s legal system handles M&A transactions from an antitrust perspective. The paper concludes with recommendations for improving the M&A legal framework to ensure a more efficient, competitive market environment.
